Acceptable Use Policy

What you may host on KataBump, what is prohibited, and the measures that apply in case of breach.

This policy sets out what you may and may not host on the KATABUMP Association's infrastructure. It expands on Article 6 of the terms and conditions of use, of which it forms an integral part: failing to comply with it is a contractual breach within the meaning of Article 9 of those terms.

It applies to all services: hosting of Node.js and Python applications, the kdns.fr domain name service, the dashboard, the AI assistant and the community spaces.

1. General principle

You alone are responsible for what you host and for what your application does. The Association carries out no systematic prior review of hosted content, in accordance with Article 8 of the terms and conditions of use; it acts when a breach is reported to it or otherwise comes to its knowledge.

You must comply, at all times, with:

  • French law and the law of the European Union;
  • the terms of use of the third-party platforms your application interacts with, first and foremost Discord's Terms of Service and Developer Policies;
  • the rights of third parties, in particular intellectual property rights and the right to the protection of personal data.

2. Prohibited content and activities

It is prohibited to use the Services to host, distribute, relay or facilitate:

2.1 Manifestly illegal content

  • child sexual abuse material, or content depicting minors in a sexualised manner;
  • glorification of, provocation to or incitement to terrorism;
  • incitement to hatred, violence or discrimination, or insult or defamation on the grounds of origin, ethnicity, nationality, race, religion, sex, sexual orientation, gender identity or disability;
  • denial of crimes against humanity;
  • content that undermines human dignity, public order or public decency;
  • harassment, threats, invasion of privacy or disclosure of third parties' personal data (doxxing).

2.2 Malicious activities

  • distribution of malware, ransomware, keyloggers, backdoors or credential-stealing tools (stealers);
  • command-and-control infrastructure, botnets, attack relays;
  • denial-of-service attacks, port scanning, penetration testing or brute-force attacks against third-party systems;
  • phishing, fraudulent sites, impersonation of a service, a brand or a person;
  • fraud, scams, sale of illegal goods or services, money laundering;
  • crypto-asset mining and, more generally, any activity whose sole purpose is to consume computing resources.

2.3 Discord-specific breaches

  • Self-bots: automating a Discord user account is prohibited. The corresponding requests are blocked and the account is automatically reported to our team.
  • mass collection of member, server or message data without a legal basis;
  • unsolicited bulk messaging, intrusive advertising, raid or nuker tools, or any tool designed to harm a Discord server;
  • circumventing Discord's API limits or its security mechanisms.

2.4 Abusive use of resources

  • deliberately overloading the Association's servers or degrading the service for other users;
  • exceeding the limit of 250 requests per minute to the Discord API set for each hosting account;
  • reselling, subletting or otherwise making available all or part of the allocated resources;
  • using the hosting as storage space, as a traffic relay (proxy, VPN, tunnelling) or for any purpose unrelated to running an application;
  • attempting to access data, systems or accounts you are not authorised to access.

2.5 Circumventing the free plan

Article 6 of the terms and conditions of use limits the free plan to one service per account and per household. Multi-accounting, or using a VPN, multiple e-mail addresses or different identities to exceed that limit, results in suspension without warning. The same rule applies to the limits set for kdns.fr domain names, under Article 16.5 of those same terms.

2.6 kdns.fr domain names

The rules specific to second-level domain names are set out in Article 16 of the terms and conditions of use. Prohibited in particular are domain names that reproduce or imitate a trade mark, a company name or a distinctive sign belonging to a third party, as well as those intended to impersonate someone. A domain name may be suspended as a precaution on the basis of its wording alone.

3. What is allowed

All types of bots and applications are accepted provided they comply with the rules above. If you are unsure whether your project complies, contact us before deploying it, on our Discord or at support@katabump.com.

4. Reporting a breach

Anyone may report content, an application or a domain name that breaches this policy. The channel depends on what the report is about:

Where the report concerns illegal content, it follows the procedure described in the Reporting and complaints (DSA) document, which sets out what a notice must contain and how quickly it is handled.

5. Enforcement measures

Depending on the seriousness of the breach, whether it is repeated and what it leads to, the Association may take one or more of the following measures:

Minor or likely unintentional breach Warning and request to remedy within a set time
Unremedied breach, or resource abuse Temporary suspension of the server concerned
Circumvention of the free plan or of the applicable limits Suspension without prior warning, in accordance with Article 6 of the terms and conditions of use
Manifestly illegal content Immediate removal or disabling, without notice
Serious or repeated breach Termination of the contract and permanent closure of the account, with no compensation and no refund of Credits
Criminal offence Reporting to the competent authorities and, where applicable, to Discord

These measures apply without prejudice to Article 9 of the terms and conditions of use (termination) and Article 12 (indemnification).

6. Challenging a measure

Every restriction is accompanied by a statement of reasons and can be challenged free of charge for six months, on the terms described in section 5 of the Reporting and complaints (DSA) document. The complaint is reviewed by a person other than the one who took the original decision.

7. Changes to this policy

This policy may change, in particular to reflect new uses or a change in the legal framework. Material changes are brought to your attention on the terms of Article 13 of the terms and conditions of use.
